Terms and Conditions
Welcome to Swim Shine Aquatics! Please review the following Terms and Conditions carefully before enrolling. These policies outline liability, registration requirements, photo/video consent, refunds, cancellations, and program guidelines designed to ensure a safe and positive learning experience for all swimmers.
Waiver and Release of Liability
This is a release of liability and waiver of certain legal rights.
I, the parent/guardian of the participant(s) listed above, understand that swimming involves inherent risks, including but not limited to serious injury, paralysis, or death.
By enrolling, I:
* Agree to allow the participant(s) to participate in swimming lessons and activities with Donna Mallon / Swim Shine Aquatics.
* Agree to indemnify and hold harmless Donna Mallon / Swim Shine Aquatics from any liability or damages that may occur during lessons at any location.
* Authorize Donna Mallon / Swim Shine Aquatics to arrange medical treatment in the event of an emergency and agree to assume all associated costs.
* Understand that while lessons are in session, instructor attention is focused on participants, and I agree to indemnify Donna Mallon / Swim Shine Aquatics from liability for any injury to observers.
Important: Do not start your child in this program unless you fully intend to complete the entire learning process. Early sessions are critical for adaptation and water confidence.
All lessons must be completed within one (1) year of the purchase date.
No refunds are offered under any circumstances.
Photo/Video Authorization
I give permission to Swim Shine Aquatics to record and use photographs, video, or other likenesses of the participant (and myself if applicable) for lawful business purposes, including:
* Print or digital advertising
* Website and social media
* Promotional or training materials
I consent to the use of names and voices in connection with such media.
If I wish to opt out, I will notify the instructor on or before the first lesson.
Refund Policy
* No refunds are provided under any circumstances.
* Completion of the full program is essential for the swimmer’s skill progression and confidence in the water.
Cancellation Policy and No-Show Agreement
* Cancellations must be made at least 24 hours in advance through Acuity to reschedule.
* No-shows are counted as a completed lesson.
Payment and Registration Policy
* All lessons must be paid in full at the time of registration.
* Private lesson spots are reserved once payment is received.
* Payment includes all registration/admin fees, underwater pictures/videos, music reels, and a swim medal upon completion.
Swim Diaper Policy
* All children not fully potty-trained must wear a reusable swim diaper with snug-fitting legs and waistband (e.g., Splash About, iPlay).
* Disposable diapers are not permitted in the pool.
Acknowledgment
By enrolling, I confirm that I have read, understood, and agree to all Swim Shine Aquatics Terms and Conditions, including the waiver of liability, refund, cancellation, and media policies.
