Waiver Release of Liability

This is a release of liability and waiver of certain legal rights. I the parent/guardian of the participant(s) listed above, agrees and understands that swimming is a hazardous activity. I recognize that there are risks inherent in the sport of swimming that includes but not is limited to paralyzing injuries and death. I hereby agree to allow the participant(s) to participate in the swimming activities and swimming classes with Donna Mallon. I hereby agree to indemnify and hold harmless Donna Mallon from any liability for or from any damages that may occur to the participant while the participant is being instructed on any location. I also agree to indemnify Donna Mallon for any damages incurred arising from any claims, demand, action, or cause of action by the participant(s). I hereby authorize Donna Mallon to have the participant(s) treated in medical emergency during the participation at the location of swimming activities and swimming lessons, I agree to pay all costs associated with medical care and transportation for the participant. I recognize that while swimming activities and swimming lessons are in session, the attention of Donna Mallon are on the participant and the swim lessons. Accordingly, I hereby agree to indemnify and hold harmless Donna Mallon from any liability resulting from any injury that may occur to myself or anyone else who attends the swim lessons as an observer. Furthermore, I agree to indemnify Donna Mallon for any damages incurred arising from any claims, demands, actions, or causes of actions by any such observer. Please do not start your child in this program unless you fully intend to complete the entire learning process. The reason Swim Shine Aquatics places this firm responsibility on you – is the first few weeks of training is a very critical time of adaptation to a new environment, instructor, and technique for you and your child. It can be a time of very low self-confidence in the water because the child has not had time to acquire and perfect his/her skills in the aquatic environment. If the child’s lesson is terminated during this time, the foremost thing the child will remember about the water is that lack of self-confidence in and around water. All lessons must be completed within 1 year of purchase date. Under NO exceptions do we offer refunds  

 

Photo/Video Authorization

I give permission to Swim Shine Aquatics to record and utilize photographs or other likeness of the Participant (and myself if I am not a Participant) on digital video, audiotape, photographs or other mediums in all forms of advertising, trade and any other lawful purposes including but not limited to print advertising, photographs, digital video, website, and social media. I further consent to use my name and voice in connection with such use. I understand that I may opt out of this release. Please advise instructor if you choose to opt out on day one.

• Cancel 24 hours prior to your appointment. Cancel through Acuity and reschedule.

Swim Diaper Policy

If your child is not potty trained. I recommend Splash About, iPlay, or others that have a tight waistband and legs. No disposable swim diapers or diapers are allowed in the pool!
